Reporting illegal conduct (whistleblowing)

ORLEN Projekt Česká republika s.r.o. (hereinafter referred to as the "company") has established an internal reporting system and the position of a person who receives and handles reports of possible illegal conduct that has occurred or is about to occur in the company, in accordance with Act No. 171/2023 Coll., on the protection of whistleblowers (hereinafter referred to as the "person").

Whistleblowers may submit reports under the Whistleblower Protection Act if

  • has the characteristics of a criminal offense,
  • has the characteristics of an offense for which the law stipulates a fine with an upper limit of at least CZK 100,000,
  • violates the law on the protection of whistleblowers,
  • or violates another legal regulation or European Union regulation in the area of
  1. financial services, statutory audit and other assurance services, financial products and financial markets,
  2. corporate income tax,
  3. prevention of money laundering and terrorist financing,
  4. consumer protection,
  5. compliance with product requirements, including product safety,
  6. safety, transport and road traffic,
  7. environmental protection,
  8. food and feed safety and animal protection and health,
  9. radiation protection and nuclear safety,
  10. economic competition, public auctions and public procurement,
  11. protection of internal order and security, life and health,
  12. protection of personal data, privacy and security of electronic communications networks and information systems,
  13. protection of the financial interests of the European Union,
  14. or the functioning of the internal market, including the protection of competition and state aid under European Union law.

 

The company also accepts reports of violations of rules set out in internal regulations and the company's code of ethics, as well as other reports concerning actions or omissions in the application of generally binding legal regulations and internal company regulations, including unethical conduct in the workplace and in connection with the performance of work, functions, or other similar activities for the company, as well as reports concerning actions or omissions that may expose the company to harm or violate its interests. Violations of legal regulations in connection with these areas may be reported by persons who have become aware of the violation in connection with the performance of their employment, volunteer work, professional practice, internship, or other activities in the company,

i.e.:

  • employees, including those whose employment has already ended,
  • job applicants who have learned of a violation of the law during the recruitment process or pre-contractual negotiations,
  • persons cooperating with ORLEN Unipetrol or a group of companies on the basis of a relationship other than an employment
  • relationship,
  • shareholders or members of the board of directors,
  • members of a legal entity's governing body,
  • persons performing work under the supervision and guidance of a contractor, subcontractor, or supplier,
  • interns,
  • volunteers.

The notice should be clear and understandable and should include, in particular

1. identification of the person suspected of committing unlawful or undesirable conduct and all persons involved, or persons profiting from unlawful or undesirable conduct,
2. a detailed description of the unlawful or undesirable conduct, including the time period,
3. specific evidence of illegal or undesirable conduct or other specific findings supporting the suspicion of illegal or undesirable conduct.

in writing

verbally

by telephone – to the telephone number listed above, only on working days from 8:30 a.m. to 4:00 p.m.,
verbally – with the person at the address listed above.

The identity of all whistleblowers who submit reports under the Whistleblower Protection Act is protected. Whistleblowers are protected from any retaliatory measures that may be taken against them. The person shall maintain confidentiality regarding their activities. If the whistleblower is unsure about their rights or the subject of the report, or does not wish to submit the report to the company, they can submit it via the Ministry of Justice. Instruction on knowingly false reporting

A natural person who knowingly submits a false report is not entitled to protection against retaliatory measures. The reporter commits an offense by knowingly submitting a false report, for which a fine of up to CZK 50,000 may be imposed.
